Please Bookmark and Read Mountaindale After Dark if You Have Been Following This Blog

Greetings Fellow Anti Fracking Foot Soldiers:

All those who have been following me know three things:

A) That I have not posted in this blog for some time (since May actually).

B)  That my absence here does not mean I have not been posting articles against Fracking...just that it is very hard to find time to maintain multiple blogs.  For that, I do apologize.

C)  That I have still been active in the Anti Fracking movement, was at and spoke at the NYDEC hearing held here in Sullivan County NY in Niovember.

Looking at my own time constraints, realize that I need to consolidate my efforts to better maximize my time, and better serve the Anti-Fracking movement as well.  For that reason, I have exported all the articles from this blog to my "Mountaindale After Dark" blog, where I have been posting on various issues and news items, including the issue of Fracking.

Over the next few days and weeks will also move all the useful links accumulated here on Fracktoid to the "Mountaindale After Dark" blog, and hope everyone who has enjoyed the content here will go over and check out this blog, bookmark it and follow us regularly.

If someone in the movement is interested in taking over this blog, it's twitter account, please drop me a private email at marcwoodsocialimaging@gmail.com and be happy to discuss it with you.

You can read my latest Anti Fracking article here.

The Frack FUCK Primer...Do Not Let DOE Committee Fool You

DOE trotting out Fracking Committee dog and pony show for public consumption.  Sorry, but do not buy into this supposed IMPORTANT Committee....you do not form a committee of this magnitude, and then give it just three months to review fracking if the outcome of the committee's findings are not already pre-determined. The three articles below will give you a quick PRIMER on FRACKING.

Battlement Mesa...The Tragic HISTORY of Natural Gas....Would You Believe Nuclear Bomb FRACKING?

A cursory look at the DOE, and its various sub-agencies dedicated over to Natural Gas, and you realize they have a Pro Natural Gas Industry bias that should see them STEP ASIDE when it comes to any issue involving decisions about protecting Human Health, our Environment, and our FRESH WATER SUPPLIES...simply stated, they cannot be trusted.  Imagine if you will using Atomic Bombs to FRACK for Natural Gas...far fetched right? INSANE RIGHT?  Would never happen?  WRONG, it did happen!  Back in 1969 as the DOE looked for peaceful uses for the Atomic Bomb....talk about an OXYMORON!  Now, all these years later, our Federal Government is actually wanting to let a new company drill for natural gas in the same area of the Rulison Site where in 1969 this NUCLEAR FRACKING turned out to be a dismal failure, the gas extracted so radioactive it could not be used.

Great Anti Frack Organization Meeting Today in North Branch

FRACKING is a World Wide CONCERN
On my way home today, made a significant detour over to North Branch, NY for a Volunteer Organizational meeting hosted by Catskill Citizens.  First, please visit their website.  Secondly, consider donating to their cause, as these folks are working VERY HARD to reach out to the community, educate the public to just what FRACKING is, and to persuade our politicians in Albany to do the right thing.

My biggest regret today is that I did not have my camera along with me, so have to plan a second trip to the area in and around North Branch...if you want to see just what is at risk as the (un)Natural Gas industry plans a FRACKING ASSAULT on our lands, you could not ask for a better example than the drive along 17B out of Monticello toward North Branch.  Beautiful lush farm land, steams and rivers shaded by majestic trees, fly fishermen knee deep in rushing waters, a trout on the line.  Saw one American Bald Eagle, and so many hawks that I lost count of them.  It is truly God's Country, and the Natural Gas industry wants to despoil it extracting Natural Gas to sell to China...YES, IT IS TRUE...as example, Chesapeake Energy has been selling LARGE SHARES of it's own holdings in the Marcellus Shale to overseas investors interesting in shipping it overseas, the largest deals being made with Chinese State Owned CNOOC.

Just here in lower New York State, we need to awaken and educate some EIGHT MILLION CITIZENS to the risks of Fracking, educate them on just what it is they stand to lose...both in natural beauty, and more importantly in clean fresh SAFE DRINKING WATER....to do that, organizations like that need your support, and your donations...just the yard signs that THEY HAND OUT FOR FREE are four dollars each, and trust me, the Natural Gas industry is giving away their own signs that read, "Friend of Natural Gas"...so it is imperative that organizations like Catskill Citizens have the ability to get their own signs out in peoples yards, imperiative that they have the resources to put a No Fracking button into the hands of every citizen they can find willing to wear one.  Hopefully, those reading this blog will get involved in whatever way each of you can.

Which brings me to ONE LAST REQUEST in this article.  I have been charged with a task...start compiling a list of Wolves in Sheep's clothing Environmental Groups, or Pro Natural Gas organizations that are a FRONT for the Natural Gas Industry, are wholly, or mostly FUNDED BY THE INDUSTRY...if we are to fight their PROPAGANDA CAMPAIGN, we have to identify their FALSE FRONT ORGANIZATIONS.  So, if any of you know of organizations being FUNDED BY THE NATURAL GAS INDUSTRY, please email me their Organizational Name, and if you have it a link to their website.  You can send the information to:  fracktoidnews@yahoo.com All email will be kept confidential, but every organization identified and verified as being funded by the Natural Gas Industry will be A) put on a widely distributed list, and B) featured in our newest blog project, "FRACKTURDS".

Protesters Interupt Commission Meeting in Harriburg

Anti Frack Protesters yesterday interrupted the Marcellus Shale Advisory Commission's second meeting, speaking TRUTH against a commission stacked in favorite of the (un)Natural Gas industry, most of the seats filled with industry insiders, and chaired by what can only be described as a industry whore and slut in Lt. Gov. Jim Cawley who along with Governor Corbett have an affinity for sucking on the teat of (Un)Natural Gas Industry money changers as the industry lines their pockets with Fracked Gold.

Fracking Well Pad Daily Occurance?
When one protester (Mr. Stilp)suggested that the Commission be disbanded, a new one with more CITIZEN STAKEHOLDER representation created, Lt. Governor Jim (slick lips) Cawley reportedly SNORTED, "the makeup of the commission is nowhere near as important as the information that is collected." He went on to spew forth some Paul Bunyan sized tall tale about how any one could get him information they wanted the commission to review, and he would see it was put into the right hands...YEAH RIGHT.

Nathan Sooy of Clean Water Action (one of the organizations who spear headed the protest) said Lt. Governor Cawley's assurances were not enough...and they are not.  Any anal retentive chimp tripping on LSD could look at the Commission's make up and see where the ship is being steered.  It is the tail wagging the dog, the (un)Natural Gas industry getting to create/write the guidelines that they will be willing to abide by as they rape the environment, disrupt communities, and poison water.  Voluntary compliance is a farce, and putting together a Marcellus Shale Commission wherein the industry holds the MAJORITY VOTE is worthy of the Justice Department stepping in with a RICO investigation of the Governor, Lt. Governor and various members of the commission now seated.

The Stupidity of Bought and Paid for Governments...New Brunswick Provincial Government Claims FRACKING Has Low Environmental Impact.

Opened email this morning, and a Canadian Citizen let me the following message with a LINK to this article on his government's decision to use Natural Gas as a transition fuel/energy source.

My provincial gov't claims fracking has low environmental impact and is moving against electric heat.

Suppose the first thing that surprised me, is the ignorance of the New Brunswick government...we all know that Deep Shaft Horizontal Drilling employing Slick Water Hydraulic Fracking comes with a wide array of serious environmental and health risks associated with it.   Yesterday (April 19,2011) even President Obama admitted there are some very grave concerns when it comes to FRACKING, said IF WE DO IT HERE IN AMERICA, it has to be done in a way that WILL NOT POISON PEOPLE.  So, either the elected officials have been bought off by the Natural Gas industry, or they are just plain IGNORANT OF THE FACTS.  It is guessed here, that THEY HAVE BEEN BOUGHT AND PAID FOR.

What of the most disturbing quotes from the article came from Co-Chairman Bill Thompson...it is disturbing first for its GREAT LIE that the environmental impact of Natural Gas exploitation is low.  Secondly, is the new Natural Gas SALES PITCH included in his comments, "Natural Gas is a TRANSITIONAL FUEL". It is a DEAD GIVEAWAY that the lobbyist for the (un)Natural Gas industry greased palms, paid their way into being allowed to shape Government Policy.
"Because of its competitive cost in North America today, its availability and low environmental impact, natural gas should be considered the key transition fuel as we move forward, and try to move away from our traditional fuel base."

This Pro-(un)Natural Gas bias is furthered strengthened when you hear Mr. Thompsons other ideas to create FALSE DEMAND for Natural Gas, which over time will simply drive the price up to where the industry wants it to be...it is an old trick...keep prices low/depressed while you create DEMAND, then once you have people invested in the fuel/energy source, you begin jacking up the prices.  The perfect model of this truism is OPEC.  The plan to increase demand includes (much like here in America):

  • Using (un)Natural Gas to heat public buildings.
  • Using (un)Natural Gas to run transit vehicles.
  • Building a new natural gas pipeline to connect the region with Quebec (even though only 11,000 customers out of 750,000 currently use Natural Gas).
  • Regulations to prevent the installation of electric baseboard heaters in new homes.
If you look at all this, it amounts to the Government of New Brunswick forcing citizens to financial support a industry, and a drilling technique that will negatively impact fresh water supplies, depreciate land values, and over time will shorten the lives of New Brunswick's children.  The people of New Brunswick need to wake up to the reality that their government is SELLING THEM DOWN THE RIVER.

ASK GOVERNOR CUOMO TO CLOSE THE VERTICAL- WELL LOOPHOLE!

Upon taking office, Governor Cuomo reaffirmed Executive Order 41, which bars horizontal high-volume fracking until the DEC releases a final Supplemental Generic Environmental Impact Statement. But, as we recently discovered, the industry has already been using high-volume "slickwater" fracking to develop vertical wells.

Whether injected in horizontal or vertical wells, huge quantities of fracking fluid pose the same serious risk to public health. Ask Governor Cuomo to close the vertical- well loophole by amending Executive Order 41 to bar all high-volume and all slickwater fracturing until the SGEIS is completed.

BILLS, BILLS, BILLS
No, we're not asking you for money! We're talking about Albany. The legislature is now awash in bills that would prohibit, postpone, or regulate fracking.
But are any of them going anywhere? Maybe not. At least not any time soon. We're told that the Assembly and Senate leadership intends to wait for the release of the Revised Draft SGEIS before attempting to regulate high-volume horizontal fracturing. "Give (DEC Commissioner Joe) Martens a chance to present his plan" seems to be the prevailing attitude.
But while the DEC continues to wrestle with the SGEIS, vertical fracking continues unabated. That is why bills that would regulate operations already underway in the state, need to be considered now.

END THE OIL AND GAS INDUSTRY'S "HAZARDOUS WASTE" EXEMPTION
None of the pending bills is more important than A07013/S4616. It would overturn the law that exempts oil and gas waste from being classified as "hazardous," no matter how toxic and radioactive the material may be.
It's only common sense to classify waste according to the danger it poses, rather than according to the industry that produces it, but we can expect fierce resistance from the gas lobbyists. No doubt they'll complain that it's unfair to expect them to obey same laws that apply to every other industry!

THIRTY THOUSAND CITIZENS, AND ONE ATTORNEY GENERAL
Just days after citizens submitted thirty thousand written comments about the Delaware River Basin Commission's bone-headed plan to frack the watershed that provides fifteen million Americans with their drinking water, New York State Attorney General Eric T. Schneiderman announced that he would sue the federal government unless it agreed to conduct a full environmental review of the plan. All in all, it appears it will be a long, long time before the frackers have their way in the Delaware Basin.

IT'S OFFICIAL: SHALE GAS IS DIRTIER THAN COAL!
The long awaited report "Methane and the Greenhouse-Gas Footprint of Natural Gas from Shale Formations" has been published in Climatic Changes Letters. And the conclusion should be eye-opening for anyone who ever fell for the line that shale gas is a "clean" fuel.

The [greenhouse-gas] footprint for shale gas is greater than that for conventional gas or oil when viewed on any time horizon, but particularly so over 20 years. Compared to coal, the footprint of shale gas is at least 20% greater and perhaps more than twice as great on the 20-year horizon and is comparable when compared over 100 years."

Draft versions of this report by Cornell professors Robert Howarth, Renee Santoro, and Anthony Ingraffea have been circulating for more than a year now; this final version is the first peer-reviewed study of the subject.

(un) Natural Gas-Excerpts From Landman's Bible...Dedicated to KnappAP

I was sent a link this morning via Twitter to a document file (PDF) of some five pages in length...said documents was supposedly dropped in someone's driveway (in Ohio) when the Landman came to visit.  There is a fierce lash-back from the Pro-Frack people about the veracity of the document, people like @knappAP on twitter (who for all purposes is defacto a LANDMAN) saying those of us opposed to the fracking of our lands, the ruination of our communities as neighbor is pitted against neighbor made it up.  So, upfront, will concede one point...neither side can prove the validity of the document...BUT it does ring true based upon my own time as a grassroots environmentalist that now goes back DECADES.  So, based on my own instincts, I have decided that the document passed along to me is REAL ENOUGH, I believe it was DROPPED by a LANDMAN, and that the person who found it in their driveway decided to share it with the world.  So, I have decided to share some of the salient "Quotes" from the document, as it really encapsulates the spirit and mentality of the demonspawn who aspire to be a landman, it captures the essence of the Natural Gas industry, their own Moral turpitude.

Oil and Gas exploration and drilling is meeting increasing resistance from local community groups, so it is essential to contact land holders and acquire signatures before sentiment by environmental and other public organizations limits our ability to obtain access to private land for oil and gas development.

LANDMAN BEWARE this passage seems to scream out...they (the general public) are becoming aware of our GREAT CON, and the time to quickly snatch up fistfuls of signed leases with the false promise of great wealth and riches is slipping away, so HASTE is IMPERATIVE in your task.  Go forth and lie, cheat, coerce and make false promises, as we need those leases on, over, through and UNDER (don't forget under) the land to access minerals, and we need them now.  The good news for our side, cause for us to DOUBLE OUR EFFORTS...we are being heard, and our hard work is making it harder, MUCH HARDER for these (un)Natural Gas landmen to dupe people into signing leases.

Remember, if at all possible try not to deliberately mislead the landowner, that only makes our position harder to defend at a later date.

Lets finish that sentence...but if you have to mislead the landowner, make sure you only make ORAL PROMISES and DECLARATIONS, as we all know a contract is only as good as the paper it is written on.

Most mid-west Americans dislike confrontation. Even if they disagree on a selling point, they are unlikely to confront  you over it. Therefore it is critical to obtain a lease signature in the first meeting, or at least the agreement to sign and take the lease to a notary. Drive them to the notary if you have to. If they have time to think it over, they are more likely to decline the offer.

A WORD TO THE WISE HERE...if any sales person is hard selling you, trying to get you to commit RIGHT THEN, you need to RUN AWAY, as you are about to get screwed.  There is no sale, no contract that needs to be signed RIGHT NOW.  Tell them you will get back to them, will call them.  Then take adequate time to think about the repercussions of signing a land lease (IE...you could later become a PARTY TO LITIGATION, be found to be a RESPONSIBLE PARTY if your neighbor's land is damaged as a result of drilling on your land).  Consult with an attorney, find out what your rights, and WHAT YOUR RESPONSIBILITIES ARE.

Most landowners will be patriotic Americans, and will desire to free our nation from foreign oil dependence. make certain you lead with this selling point. CHINA bought more oil than the United States last year. Fear of foreign encroachment is the biggest asset we have in selling our development strategy.

Sad that a company would play upon, take advantage of our patriotism...even worse, is what they are not telling us about their own business model.  Using just one company (and there are numerous examples), Chesapeake Energy" we should inform you, that all this Natural Gas that is supposed to break us of our dependence on FOREIGN OIL is actually being sold off to Foreign companies and nations...IE, just one deal that Chesapeake Energy made with CNOOC (fully owned by the Chinese Government) sold off over SIX BILLION DOLLARS worth of American National Gas...and this is JUST ONE DEAL.

ALWAYS start your conversation with a new potential signee on a point that they will agree with. This is pure psychology. They will be more likely to let you stay and talk. Studies show the longer you talk, the more chance we have of signing.

Again take NOTICE...this is a hard sell TACTIC....they want your (husband and wife) signature on that lease THAT DAY AT ALL COSTS, and have devised ways to get it...pitch the positive, and BUY TIME TO WEAR THEM DOWN.

At any point in the pitch if talk turns to local issues, environmental hazards, etc.. .a good way to re-direct the conversation is to re-engage over the nation's energy needs and the desire to be oil self-reliant. Come back to the mutually agreed upon point about freeing the nation. CHINA bought more oil than the United States last year!

Return to your MAJOR TRUMP CARD...patriotism, make it seem like the owner of the land would be UN-AMERICAN if they did not let the company rape their lands in the name of AMERICA,,,God save America, land of the FREE...stand beside me, and guide me as I sign on thee DOTTED LINE...and wrap, exit stage left with another LEASE IN HAND.

We are a small business, working closely with state governments when we set up wells. More educated landowners may know that we often sell our land leases to larger corporations.

Two points...they are being duplicitous from the start, presenting one picture when in reality they have ALREADY MADE A DEAL WITH THE DEVIL, are actually REPRESENTING A MUCH LARGER COMPANY without actually saying so...you should ask them about Gas Lease AUCTIONS FOLKS.  Secondly, notice the remark, "more educated landowners" and digest that...what they are really saying, is that they see many of you as not overly smart, simply local folks, EASY PICKINGS.

Stress to the landowner that we. are primarily looking for oil resources. Searching for oil is less environmentally damaging than the claims against fracing. Oil exploration has heen conducted for centuries and is safe and effective. Do not deny that gas exploration may be possible, but do not emphasize it. Distance our selling position from the movie "Gasland". We do not want landowners linking that image with our development plans.

The old SLIGHT OF HAND TRICK...take their eye off of the real target of your desires, keep them confused, assure them you are an OIL MAN, not a GAS MAN, but make sure you tie up THE GAS RIGHTS, as that is what we really want.

If anyone knows about slick water fracturing, avoid the topic. Do riot discuss the chemicals and other material used during slick water fracturing. The strategy is to state the chemical mixtures used are proprietary and are highly diluted with water when injected. Reassure landowners that no well contamination has ever been documented.  Do not mention water contamination in Pennsylvania We do not want to associate ourselves with potential ground water issues.

We all now know that WELLS HAVE BEEN POLLUTED, and SO DO THEY...yet, they continue to lie and play games.  They will tell half truths...IE, "Fracking has never contaminated a well."  Maybe, maybe not, but it has started the CHAIN OF EVENTS that will contaminate your well or underground drinking water source.

We covered only the first page and a half of this FIVE PAGE LANDMAN HOLY GRAIL...you get the picture.  We here at Fracktoid are doing our best to give you the tools to make an intelligent choice when it comes to letting the (un)Natural Gas industry onto and under your property.  Before you and your neighbors sign leases, EDUCATE YOURSELVES.  Your clean drinking water, and the health of your children and their children DEPENDS ON IT.

Natural Gas MAGIC SHOW-A must see CARTOON

A friend of mine sent me the above cartoon on fracking...

It says SO MUCH about the vile industry that is bent on destroying our lands, poisoning our drinking water in the name of profits, while at the same time wrongly playing on peoples hopes, dreams and patriotism to get their signature on a lease.  Lets dispel some of the myths the industry puts out to us.

1.  Natural Gas is clean and green...it is not.  Over a 20 year period, Natural Gas is perhaps dirtier than coal, but more importantly, the methane makes it a larger contributor to GREEN HOUSE GASES that cause Global Warming/Climate Change.

2.  Natural Gas Fracking will not poison your water, there has never been one case of ground water being damaged by fracking...this is not true, or at best a HALF TRUTH.  Fracking STARTS THE CHAIN OF EVENTS THAT WILL POISON YOUR WATER.  If you are hit by a bus, but die from internal bleeding, the Natural Gas folks would have you believe that a BUS CANNOT KILL YOU.

Look for more of these smaller articles in the says and weeks to come...please link to them, or put them on your own ANTI FRACK SITES.

Will It Take Armed Citizens Banning Together To Stop The Natural Gas Fracking?

This is not a rhetorical question...we can see numerous examples of citizens forced to let Natural Gas companies RAPE THEIR LAND...you even watch industry PROPAGANDA video, and they proudly admit to doing horizontal hydraulic fracking a FULL MILE from their well heads.  here in NY if a leasing company can get 60 percent of the land (based on acreage...not land owners) will allow them to FRACK THE OTHER 40 PERCENT over land owners objections.   Watch this video...citizens cannot even own ANYTHING UNDER THEIR LAND....THE STATE DOES!...they sell the leases, and property owners get a pittance, and a fist full of problems.  What steps in this neighbor against neighbor FRACKING WARwill communities have to take to protect their property, their water their health?  It is a question each community must make, and sadly, sooner rather than later, as the GAS ROBBER BARONS are coming to a town near you.

Fracking is becoming a common method of natural gas extraction in shale formations throughout the U.S. including:

The Marcellus shale, which extends from New York State, though Pennsylvania and West Virginia, and into parts of Ohio, Maryland and Virginia;
the Haynesville-Bossier shale in Louisiana and Texas;
the Fayetteville shale in northern Arkansas and adjoining states;
the Barnett shale in Texas;
the Eagle Ford shale, in south Texas;
the Woodford shale, in Oklahoma and Texas.

@ over on Twitter...a Natural Gas Landman and Pro Natural Gas ZEALOT apparently did not appreciate my play on words when I used banning...but then, what would one expect from someone who so easily lies to people to get their signature on a land lease?

REFRACTURING...Getting RAPED TWICE!

The old saying says one picture is worth a 1000 words...well, how about one picture as proof, and a word all those opposed to Fracking will soon fear!  The word is REFRACTURING!...imagine them coming in and Fracturing your land, then COMING IN A SECOND or even THIRD TIME! From a presentation from one"Mohd Zaki bin Awang" the staff production technologist for "Petronas Carigali Sdn Bhd" I give you the slide that talks about REFRACTURING!...well let your imaginations contemplate this.

Law Firm Who Represents VICTIMS of Fracking...

We here at Fracktoid are not making any recommendations, but do find it interesting that there seems to be a Law Firm out of Washington DC who specializes in lawsuits filed on behalf of those who become victims  (fracjtoids) of the Natural Gas Industry's disruptive and destructive drilling practices that employ Horizontal Hydraulic Fracking. So, just in case someone is in NEED OF SUCH A LAW FIRM, thought we would pass their information here for you too read!

Lost your NIGHT SKY Too Fracking?

Hydraulic Fracturing (Hydrofracking or Fracking) In Oil and Natural Gas Drilling Releases Carcinogens & Poisons Land & Water

[Introduction: If you or a loved one have suffered injuries or property damage, including water and air contamination, that you believe may have resulted from fracking (sometimes referred to as hydrofracking, frac jobs, fracting or fracing), you may have a legal claim for your injury or property damage. Our lawyers who handle fracking lawsuits are located in Washington, D.C., Maryland and Virginia.  We represent clients in complex toxic tort, drug litigation and medical product liability lawsuits across the country.  Therefore, regardless of what state you're from, please fill out the "Contact Us" form on the left side of this page or email us so that Ashcraft & Gerel, LLP can have a lawyer familiar with the fracking litigation contact you to discuss your potential lawsuit.]

Hydraulic fracturing, also known as “fracking” or hydrofracking, is a drilling process in which natural gas and oil are extracted from deep underground by injecting large amounts of water and toxic chemicals through a wellbore to break up the rock, shale rock or coal beds, thereby enabling the natural gas and oil to escape. The extremely low natural permeability of shale has prompted companies to create these fractures in the shale formations in order to form a pathway along the fractures for the gas to flow and escape.

The use of fracking by energy companies has increased dramatically around the country in the past few years.  There are hundreds of chemicals used in fracking, many of which are known carcinogens, including benzene.  These toxic chemicals are being introduced into the environment, both underground and above ground, and as a result are causing well water poisoning, land devaluation, i.e., a severe drop in the value of land affected by the fracking process.  Some property owners have reported that their well water is contaminated and is no longer safe for drinking, bathing, or washing clothes.  In addition, people have reported trouble breathing due to hazardous chemicals that have been released into the air.  These serious health concerns associated with fracking or hydrofracking have adverse effects on people, drinking water, air and property values.

If you think you or a loved one may have suffered an injury or damages, including damage to or a reduction in the value of your land as a result of fracking, you owe it to yourself to speak to an experienced toxic tort attorney to see if you have a case and to discuss the possibility of bringing a lawsuit to recover for your damages and injuries. The attorney will be able to ascertain if you have a claim for which a lawsuit can be pursued and whether the case and lawsuit can be brought to a successful settlement, verdict, award or other recovery, and the experienced lawyer will be able to advise you on any deadlines for bringing your legal claim for damages. Please contact the law firm of Ashcraft & Gerel, LLP to discuss your case with an experienced fracking lawyer.

The lawyers at Ashcraft and Gerel, LLP have been leaders in pursuing mass tort lawsuits involving unsafe drugs, defective medical devices, asbestos causing physical injuries and death as well as reduction in property values, construction disasters, contaminated food products and tainted blood. Our attorneys have successfully brought about verdicts, settlements, awards or other recoveries in these and other lawsuits on behalf of a huge number of clients over many years.

We have a toll free number to reach an attorney to answer your questions with regard to your specific case. That number is 1-800-829-7037. Please ask to speak to Robert Samet, and he will place you in touch with one of our fracing lawyers. If you would prefer, please feel free to fill out the “Contact Us” form on the left side of this page or email us. Please be sure to include your name, address, telephone number (if you wish to be called), email address and the exact nature of your question, so that our lawyer can provide you with the specific information you seek about fracking lawsuits.

Marc Black's BIO...from his own site:
Marc Black, a Kerrville 'New Folk' finalist, is one of those rare songwriters who can express humor, social awareness and tenderness side by side in his songs.  Sometimes in the same song.

Marc has been deeply involved in fighting hydro-fracking and has recorded a song with John Sebastian, Eric (dueling banjos) Weissberg and a hundred citizens singing along on the chorus! His newly released music video, I Love You Rachel Maddow, has been viewed more than 6,000 times!

His most recent CD, Pictures of the Highway was #34 for the year on the National Folk DJ Chart. One tune, Ooh I Love My Coffee, got as high as #6 and was named Folk Song of the Year on ABC Radio's Fame Games.  And Marc was named Folk Artist of the Year.

The Marc Black Band currently features amazing players including John Sebastian from the Lovin' Spoonful, Warren Bernhardt from Simon & Garfunkel, Eric Parker from the Joe Cocker Band and Mike Esposito from the Blues Magoos!  He's also recorded with a host of luminaries including Art Garfunkel, Richie Havens, and Taj Mahal.

Marc has explored many unusual avenues with his songwriting.  His Stroke of Genius CD, that was based on the poetry of a stroke survivor who was in a coma for 21 days and only woke up after his doctors had pulled life support.  Marc produced a documentary film of this experience and he's been traveling all across the Country presenting this work to stroke and aphasia support groups.

When Marc was still in high school, his band, the 'Blades of Grass', had a top forty hit and toured with the Doors and Van Morrison.  Next stop was Woodstock, NY where he lived in Tim Hardin's house and put together a band that attracted world famous musicians and a dedicated following.

He's recorded more than a dozen CD's, including a ‘pick hit’ in Billboard Magazine, and another recognized as a ‘minor masterpiece’ by famed music A&R man, John Hammond Sr. and a childrens album, recorded with Richie Havens and Taj Mahal, that was awarded Best of the Year honors by the American Library Association.

Happy Traum recently wrote about Marc's new CD, Pictures of the Highway…'Foot-tapping grooves, excellent playing, top notch guitar and vocals…Marc's songs are timeless."

Hydraulic Fracturing Going On In New York During Moratorium with NY DEP PERMISSION

Whoever says we have a Moratorium on Natural Gas Exploration deploying FRACKING within the Marsellus Shale here in NY, on some level, are not stating a completely accurate case.  The NY DEP has approved some limited fracking....specifically in Oswego County at the Ross 1 well.  You can read a very interesting and disturbing Power Point presentation here (downloadable PDF file).  The company involved is Gastem USA, and one's eyebrows raise from the start with the title of the document which is "Environmental Concerns and Mitigating Actions, Oswego NY".  The company DEFACTO makes a tacit admission that their drilling/fracking activities will do harm to the environment that will require mitigation efforts, and the NY DEP, even though the rules have not been fully written and approved (Final Draft GEIS) went ahead On October 25,2010 gave this company permission to FRACK.

First question one has to ask themselves, "Has the NY DEP been doing nothing more than giving concerned citizens and environmental groups LIP SERVICE, while working behind the scenes with the Natural Gas industry to give them JUST WHAT THEY WANT?"  Their approval of Gastem's proposal to Hydraulically FRACTURE the Marcellus Shale formation in Oswego County would suggest this is the case.  This would not be the first time that NY DEP is talking out of both sides of its mouth...all one has to do is look at the unlicensed/permitted water discharge canal at the problem plagued Indian Point nuclear reactor, look at NY DEP's refusal to use their enforcement abilities to shut down the reactors, and you have proof positive that NY DEP too often tells the public one thing, while behind the scenes they are cooperating with law breaking polluters.

Secondly, what about those environmental concerns...well, we could talk about the almost 39,000 gallons of contaminated backflow that was disposed of at the local Watertown disposal facility...fact is, that facility was not built and designed to handle Fracturing Contaminated Waste Waters.    Additionally, are some of the things they were testing for PRE-DRILLING, as it gives one a eye into just what kinds of contaminants property owners and neighbors can expect as full drilling of the Marcellus Shale moves forward...the first one this writer noticed as an anti-nuclear grassroots activist was strontium...a cancer causing radionuclide  carcinogen that collects in the bones that many believe has contributed to the increase in childhood cases of leukemia.  Other carcinogens of concern include chromium, lead and mercury...talk about a lethal cocktail meant to kill almost any living creature or thing over time...no wonder FRACKED lands are coming up with three legged blind cows, and citizens who are getting sick.
Would love to have NY DEP come to this blog and explain themselves, explain why Gastem's proposal was approved during a time where we are supposed to have a Moratorium on Fracking in New York's Marcellus Shale.

Other examples of this company being ALLOWED TO FRACK with NY DEP approval.  Maybe a peaceful mass protest should be organized at the well site...let me know your opinions.

Mike Knapp, YOU ARE The Company You Keep

Seems that Mike Knapp (who seems to be nothing more than a Landman willing to say, do anything to get a landowners signature on a a lease at all costs) is raising a Holy War, A Jihad against Josh Fox whose movie "Gasland" has taken the nation by storm, and is helping to WAKE UP average citizens to the harm and peril that (un)Natural Gas represents.

Seems that Josh's father was cited for burning of a trailer on his property in Pennsylvania...there is a citation for this.  Josh Fox does not own the property, which means any issues surrounding this are not his.  More importantly though, Mr. Mike Knapp wants to ignore some important material facts surrounding this issue, primary among them:

A)  Josh nor his father knew the trailer HAD BEEN TORCHED.
B)  When the Fox family learned of this arson, they IMMEDIATELY contacted the State Police, and there is currently an investigation going on.
C)  The Pa State Police have clearly stated that the Fox family (father and son) are not responsible, have pretty well said the fire was DELIBERATELY SET (arson).

A December fire that destroyed a Fox family mobile home cited for junk violations was set by someone other than Fox or his family, according to Pennsylvania State Police.

The fire, across the Delaware River in Wayne County, Pa., was discovered by Fox last week. He had just returned to the Milanville property from a promotional tour for his film, which has riled pro-drillers, who blast it for what they say are inaccuracies.

"There's nothing to suggest either he or his family had anything to do with it," said Pennsylvania State Police Fire Marshall Russ Andress, who said the trailer burned while Fox was on the road. The fire is still under investigation, he said.

Mike Knapp President of Knapp Acquisitions & Production LLC Kittanning, PA apparently does not want to let FACTS get in the way of a good smear campaign as he employs the normal scorched earth attacks that the Energy Industry has used for years when grassroots activists are having success in bringing attention to indsutry practices that are unsafe, that threaten our environment and our health. This (un)Natural Gas Landman from the get go lets everyone know just how unsavory and despicable he truly is...notice that his Knapp Acquisitions company which bears his name is a LLC (Limited Liability Company, which means he has set himself up personally to be free of legal responsibility should ANYTHING GO WRONG...IE, say false promises, or verbal promises made to fraudulently get someone to sign a lease that end up in some kind of litigation...you can sue HIS COMPANY, but not him, and trust me, be willing to bet here that Mike Knapp drains the profits out of this enterprise almost as fast as they come in.  Which brings us to the company he keeps...if you do a cursory internet search, you will find out that HIS CLIENTS have been cited for some very SERIOUS VIOLATIONS, his clients are CHARGED with violations that have done some SERIOUS HARM to the environment already.

Now we know the kind of people that Mike Knapp associates with, know that he is at best a hypocritical man who should spend some time worrying about the dung heap stinking up his own back yard, and less time attacking a man and a movie that SPEAKS TRUTH TO THE INDUSTRY that wants to rape our lands, poison our waters, and bring cancers to our doorsteps.

PS...you can judge a SCUM by their action.  Want to know just how LOW people in the (un)Natural Gas industry can go...visit the website of Mr. Knapp and on the front page you find this:

Just in From Catskill Citizens...THE FRAC Act is Back!

GOOD NEWS...The FRAC Act has been reintroduced in the House and the Senate.  This very important bill will require frackers to disclose the chemicals they inject underground and will once again subject hydraulic fracturing to the Safe Drinking Water Act, thereby closing the "Halliburton Loophole" in the Bush/Cheney Energy Act of 2005.    Even if you previously expressed support for the FRAC Act, it's important to speak up now because Washington works differently...as far as Congress is concerned, H.R.1084/S587 is a new piece of legislation.

New York is already FRACKED.  Big time.

Despite a three year de facto moratorium on high-volume horizontal hydraulic fracturing, more than 10,000 oil and gas wells have already been fracked in New York State, and that number is growing every day.   That is NOT A TYPO FOLKS...despite the moratorium, 10,000 Hydraulic fracturing wells have been drilled here in NY.

Recently Catskill Citizens used the Freedom of Information Law (FOIL) to obtain information on a few of these wells.  We decided to look at the two dozen that have already been drilled in the Marcellus Shale.   What we found was disturbing, sometimes shocking.

Records show that these Marcellus wells were fracked with dozens of chemicals including carcinogens and neurotoxins.   We expected that.

But we also encountered page after page of blacked out information.  And while it's hard to know exactly what information is being withheld, it certainly seems to go well beyond the secret chemical ingredients that the frackers claim are "proprietary".   Information on chemical transportation and storage was also censored, and sometimes even the DEC forms themselves had been redacted! Note from fractoid...might be time to put people to the task of surveillance of these sites.

While we haven't examined all the records yet, we've already found evidence of numerous violations, including gas leaks and water contamination.

But the most startling find of all was the huge volume of fracking fluid that is now being injected in New York's vertical wells.  Today's operations are a far cry from the 20,000 to 80,000 gallon frack jobs described in the DEC's 1992 Generic Environmental Impact Statement (GEIS).   According to the records we obtained, vertical wells are now being injected with around 350,000 gallons of fluid.   We found one Marcellus well was has been fracked with 646,000 gallons toxic fluid!

Despite dramatic changes in fracking technology over the last twenty years, New York's DEC still permits vertical wells to be fracked according to ground rules that were developed in the late eighties and early nineties.   This must change.  New York needs to move quickly to put a halt to all fracking operations.  If any fracking is permitted in the future, it must be subjected to the new Supplemental GEIS that is now being developed by the DEC.

Aluminum Chloride Use In Fracking...Who Cares If You Have Trouble Breathing...They Have (un) Natural Gas

Did you know a Natural Gas Rig close to your house runs 24 hours a day, 365 days a year, with crews working in 12 hours shifts...in short, you are never free from the onslaught.

As I delve deeper into this issue, one thing is certain...those wanting to drill for Natural Gas, those wanting the energy it could provide seem to think nothing of the inconveniences it will cause local communities, seem at best apathetic to the health and environmental issues surrounding this troublesome rush to employ  Fracking in the capture of and processing of America's abundant natural gas sources...question is, what is a fair price to ask us in the affected areas to pay so that you can have access to additional energy sources in the large Metro Area population centers?  Today's chemical...

Aluminum Chloride

Inhalation:
May cause irritation to the respiratory tract. Symptoms may include coughing and shortness of breath.
Ingestion:
Low single dose toxicity. Ingestion of large amounts may cause nausea, vomiting and abdominal spasms.
Skin Contact:
May cause irritation.
Eye Contact:
May cause irritation, redness and pain.

Again, if one takes just a bit of time to investigate the complaints of those living near a Natural Gas well, these are some of the very symptoms they are complaining of, but in a callous disregard for the local communities these Ungodly wells are in, the Gas Companies (think Chesapeake Energy as example) simply shake their heads, laugh and look at the local citizens and say, "PROVE IT IS US", knowing the well will have been played, and themselves long gone before the people start dying off.
